I. Introduction
These are the Terms and Conditions (“Terms” or “Agreement”) for using, visiting, and purchasing products and/or services from www.hipfitatl.com, (“Site”). Site is owned and operated by HIPfit Atlanta (“we,” “our,” “us,” or “Company”), a limited liability company located at 742 Ponce De Leon Place NE Atlanta, GA 30306.
Please read the Terms carefully. This agreement is between Company and User (“you”, “your”, “client”, “member”, “subscriber”, “visitor” or “customer”). Your access to and use of the Site is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Site. Our privacy policy relates back to these terms and can be found under “Privacy Policy” section of the Site.
This Website is offered and available to users who are 18 years of age or older. By using this Website, you represent and warrant that you are of legal age to form a binding contract/agreement with us.
II. Lawful Purposes
You may use the Site for lawful purposes only and must not use this site to conduct any illegal activity within your jurisdiction. You agree to be financially responsible for all purchases made by you or someone acting on your behalf through the Site. You also agree to use the Site and to purchase services or products through the Site for legitimate, non-commercial purposes only. This means you will not profit from or repurpose any of Site’s contents for your own business or commercial gain.
By using this Site, you agree not to transmit any material that violates or infringes the rights of others. This includes but is not limited to threatening, abusive, libelous, vulgar, profane, or criminal activity and content.
III. Purchases
If you wish to purchase any product or service made available through the Site, you may be asked to supply certain information relevant to your purchase including, but not limited to, your personal contact and payment information.
IV. Payment Terms
Pricing details can be found here at: https://www.hipfitatl.com/pricing. Purchasing classes, class packs, or membership is conducted online through the Marianatek application.
Downloading the app will allow for the most streamlined experience but in-person purchases in the studio are also available for students.
Please note that HIPfit Atlanta does not currently accept cash payments
a. Cancellation and Refunds
All payments are final. Refunds will be issued only after certain extenuating circumstances have been demonstrated or legal impossibility has caused the delivery of services or products to be halted.
V. Recurring Payments
Membership requires a three-month minimum commitment which shall be billed monthly in accordance with the purchase date. After three months, students will be billed monthly on a recurring basis. Cancellation of membership will require a 30-day notice from the bill date. Students are encouraged to contact HIPFit Atlanta immediately should they have any questions or concerns regarding billing.
VI. Class - Membership Type
a. Membership requires a three-month minimum commitment which shall be billed monthly in accordance with the purchase date. After three months, students will be billed monthly on a recurring basis. Cancellation of membership will require a 30-day notice from the bill date. Students are encouraged to contact HIPFit Atlanta immediately should they have any questions or concerns regarding billing.
If you cancel your class reservation within eight (8) hours of class time, you will lose this class for the month.
If you no-show to a class without canceling late, you will incur a fee of $15
b. Class Packs are available in sets of 5, 10, or 20. Five and Ten Class Packs expire six (6) months after purchase and the Twenty Class Pack expires after one year from purchase date.
i. No-shows and late cancellations will result in losing the class.
VII. Intellectual Property Rights
We maintain the rights to all images and copy presented on the site as the rightful owners of the original intellectual property. By using this Site you agree not to copy, infringe, or misuse any information presented on the Site for personal or commercial use.
VIII. Liability Waiver
Students will be required to sign the following before proceeding with any class.
We recommend that you consult your physician before starting any exercise program. Please feel free to ask your coach any questions you have concerning your fitness lifestyle goals. I hereby affirm that I am in good physical condition and do not suffer from any mental or physical disability which would prevent or limit my participation. I understand that I am participating in a program of strenuous physical activity including but not limited to high-intensity Pilates, and slow resistance strength training. I understand and am aware that strength, flexibility, aerobic exercise including the use of exercise equipment, and any program at HipFit Atlanta may involve potentially hazardous activities. I also understand that fitness activities involve risk or injury, even death and that I am voluntarily participating in these activities. I authorize HipFit Atlanta to take pictures and movies of me and use them on their website and other promotional and educational materials. I hereby agree to expressly assume and accept any and all risk of injury and death. In consideration of my participation in training at HipFit Atlanta, I, for myself, my heirs, and assigns, hereby release HipFit Atlanta, its instructors, and owners from claims, demands, and causes of action arising from my participation in any program at HipFit Atlanta. I fully understand that I may injure myself as a result of my participation in a program at HipFit Atlanta and I hereby release muscle strains, broken bones, shin splints, back injuries, or soreness, occurring during or after my participation. I hereby affirm that I have read and understand fully all of the above.
IX. Other Sites
Company may provide links and/or references to other websites that are not owned or controlled by Company or related to this Site. Company assumes no responsibility, nor does it have any control over the content, policies, or practices of any third-party website.
You acknowledge and agree that Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.
X. Limitations
By using this site User understands that Company is not liable for personal or professional outcomes that may or may not arise as an alleged result of viewing the Site's Content. Users are advised to consume content as educational and to use personal discretion in how and when to apply such information.
XI. Amendments
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least thirty (30) days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
XII. Entire Agreement
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and the Company with respect to the Website. This Agreement supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the user and the Company with respect to the Website.
XIII. Governing Law and Venue
These Terms will be governed by the laws of Georgia without regard for conflicts of laws principles. Each Party consents to the personal jurisdiction of the state and federal courts located in Fulton County for any lawsuit filed concerning any matter arising from or relating to these Terms.
